FELA OVERVIEW
One hundred and two years ago, in 1908, the United States Congress passed a federal law called the Federal Employers Liability Act (45 USC § 5 et.seq.) It is designed to cover the Nation's railroad workers when they are hurt on the job working for the railroad. Congress passed this law because railroading is not an intra state job but an interstate job where freight and people are transported between the states in interstate commerce. In essence this means that a railroad workers sole and only remedy when he is hurt on the job is the FELA as no states workers compensation law applies.
