
PERSONAL INJURY OVERVIEW
During the time of the Roman Empire, the legal concept of individual rights was debated by the Roman Senate and the Justinian Code was subsequently affirmed. It recognized that every person has the absolute right to be paid for whatever loss he sustained by the fault, mistake or negligence of another. This concept known as a principle of law made its way across Western Europe to England and ultimately across the Atlantic to America. It is one of the bedrocks of the United States Constitution. Therefore, if you are hurt by another, whether it be a person or a corporation, you have the absolute right to be made whole in a civil court of law in our country.
However, depending on the harm or injury sustained, which is commonly called damages, and the particular situation involved in causing such a loss different bodies of law are applicable.
Thus the set of laws that apply to one hurt in an automobile accident are totally different than the laws that apply to a railroad worker or a person hurt at sea in the maritime industry or in an aviation accident even though all involve injuries (or death) to a human being.
